Pacifica Paddle Sports Acknowledgement of Risks and Informed Consent Agreement for Minors

(hereinafter referred to as the “Informed Consent Agreement”)

ORGANIZATION NAME: Pacifica Paddle Sports and its directors, officers, employees, instructors, guides, agents, representatives, independent contractors, subcontractors, suppliers, sponsors, successors and assigns (all of whom are hereinafter referred as “Pacifica Paddle”). 

DEFINITION In this Informed Consent Agreement the term “Water Activities” shall include all activities, events or services provided, arranged, organized, conducted, sponsored or authorized by Pacifica Paddle and shall include, but is not limited to: whitewater, still water and ocean canoeing, kayaking, paddle boarding and snorkeling; rental or use of related equipment; orientational and instructional courses, seminars and sessions; and all travel, transport and accommodation. 

RENTAL AGREEMENT As the responsible parent/guardian of the student participating in water activities, I accept full responsibility for the Equipment rented and agree to pay for any damage to the Equipment and replace the Equipment at full retail value if not returned by the agreed date. I acknowledge that Pacifica Paddle is only responsible for the rental of the equipment to West Point Grey Academy (WPGA) and its students, employees, guides and other leaders, and the equipment is in good working order upon the start of the rental period. 

SAFETY I acknowledge that my child (and all participants) have been advised to wear an approved personal floatation device during any Water Activities and to carry other safety equipment such as spray deck, pump, paddle float, and bailer. All participants must agree to wear the PFD at all times when on the water or at the shoreline, and they are at fault if they take it off while on the water or at the shoreline. I am familiar with the proper use of the Equipment, including how to self-rescue, and of the water environment including tides, currents and weather effects. I am aware that there are Pacifica Paddle Staff members available to answer any questions that I or my child may have as to the proper use of the Equipment when the rental equipment is being given to WPGA, and that I or my child need to direct questions to WPGA during the water activities. 

ASSUMPTION OF RISKS I am aware that Water Activities involve many risks, dangers and hazards including, but not limited to: accidents which occur during transportation or travel to and from location of Water Activities; slip and falls while getting into or out of the Equipment; overturning of the Equipment; loss of balance; impact, collision with or entrapment by trees, logs, deadfall, boats or equipment or other participants; hypothermia; drowning; changing and inclement weather conditions including storms, high wind, high waves, and lightning; encounters with domestic or wild animals; failure of the Equipment; negligence on the part of other participants; and NEGLIGENCE ON THE PART OF PACIFICA PADDLE, INCLUDING THE FAILURE ON THE PART OF PACIFICA PADDLE TO SAFEGUARD OR PROTECT ME FROM THE RISKS, DANGERS AND HAZARDS OF PARTICIPATING IN THE WATER ACTIVITIES OR MY USE OF THE EQUIPMENT.

Pacifica Paddle is only responsible for their own actions, and our responsibility is limited to providing the equipment and an orientation of the equipment on the first day of the rental, and space in a boat barn to organize and pack gear into the kayaks, and welcoming the group back to the dock and boat barn at the end of the rental period, when we receive back our rented property. At Pacifica Paddle, safety is a high priority, and we maintain our fleet of rental equipment so as to provide a safe rental experience for all customers. All leadership decisions and actions including group management on and off the water, is solely the responsibility of WPGA and the guides they hire, not Pacifica Paddle. Pacifica Paddle recommends following the standards set by the Sea Kayak Guides Alliance of British Columbia (SKGABC), by hiring experienced guides with Assistant Overnight, Level 2 and/or Level 3 SKGABC certification, and following the ratios set by SKGABC. As the responsible parent/guardian of the student participating in wilderness activities, I am aware of the risks, danger and hazards associated with wilderness activities and, on behalf of my child, I freely accept and fully assume all such risks, danger and hazards and the possibility of personal injury, death, property damage or loss resulting therefrom. 

In consideration of Pacifica Paddle accepting the application of my child to go on a sea kayak trip, I acknowledge the risks associated with such water activities and I understand Pacifica Paddle will be providing kayak and equipment rentals only. Guides will be provided by WPGA. I accordingly agree I am not relying on any verbal or written inducements made by Pacifica Paddle or their staff to encourage my child’s participation on a trip. 

I confirm that I am the responsible parent/guardian of the student and that I have read and understand the water activities as outlined in this “Acknowledgement of Risks and Informed Consent” document. I give my informed consent for my child, 

  to participate in sea kayaking on April 2-6, 2024, and for them to participate in the related water activities as outlined in the Acknowledgement of Risks and Informed Consent notice.
